Professional development workshop for member of EU+ Courts and Tribunals on Detention of Applicants for International Protection

Through its Network of EU+ Courts and Tribunals Members, EASO provides support to all major judicial stakeholders (including the CJEU, the ECtHR, judicial associations and networks, academic institutions, EU agencies and UNHCR) in the field of international protection law, through the publication of training and reference materials together with professional development workshops.

Based on a needs assessment, it was decided during the 2018 Network’s annual steering meeting to cover the topic of the detention of applicants for international protection. Soon after, a group of judicial experts from Austria, Bulgaria, Czech Republic, France, Germany, Greece, Slovenia together with a representative of the UNHCR, began working together to develop a Judicial Analysis, Compilation of Jurisprudence and Judicial Trainers’ Guidance Note on this sensitive issue.

Pending the publication of this new chapter of the EASO Professional Development Series (PDS), a pilot workshop was held on 6 and 7 March 2019 in Malta, with the aim of testing the newly developed content on 20 judges from 9 EU Member States and a FRA representative. During the session, led by two EASO Judicial Trainers from Greece and the United Kingdom, the key issues of lawfulness, necessity and proportionality with regards to the detention of applicants for international protection were highlighted. Major sources of EU law on the topic were covered, with a particular focus on the legal grounds for detention as well as alternative measures and specific safeguards for applicants.

The methodology of the workshop, which involved discussions around case studies and practical implementation through a lively moot court exercise highly contributed to the horizontal judicial dialogue to which EASO is fully committed under its mandate to support Members of Courts and Tribunals in the implementation of the Common European Asylum System (CEAS).
