Description

The aim of this module is to provide asylum officials with structured and detailed guidance on complex interpretative issues relating to qualification for international protection.
This module focuses on more complex aspects of qualification for international protection with regard to acts of persecution, reasons for persecution, serious harm (subsidiary protection) and protection from persecution or serious harm. It critically assesses the work of asylum case officers in the context of national practice and CEAS-related jurisprudence while applying conclusions drawn from the work of the Court of Justice of the European Union (CJEU) and the European Court of Human Rights. This module also explores a method of interpreting EU law and international protection law in the absence of guidance from the CJEU when facing complex interpretative issues relating to qualification for international protection.

 

LEARNING OUTCOMES

  1. Critically assess work in the context of different Member States’ practices and CEAS-related jurisprudence
  2. Apply conclusions drawn from European jurisprudence, mainly from CJEU case-law and European Court of Human Rights case-law
  3. Address interpretative issues relating to qualification for international protection in line with the CJEU’s method of interpretation of EU law, in the absence of direct CJEU guidance
  4. Provide structured and detailed guidance on complex interpretative issues relating to qualification for international protection
 
This module is delivered through a blended learning methodology (online and face-to-face). Online learning contains learning activities that assess progress toward the learning outcomes, and face-to-face sessions focus on complex elements that require discussion.
In 2023, this module will be upgraded as part of the restructuring of the European Asylum Curriculum.
